The following Privacy Policy applies to the products and services provided by GuideNest PTY LTD ACN 691 264 623.

In this policy:

“Carer” means a person who provides care or support to a Child, including a parent, guardian, family member, or other person with responsibility for the Child’s welfare;

“Child” means a child or young person in respect of whom a Carer uses the Service;

“Health Information” has the meaning given in the Privacy Act 1988 (Cth) and includes information or an opinion about the health, including an illness, disability or injury, of an individual, or about an individual’s expressed wishes about the future provision of health services to him or her;

“Personal Information” has the meaning given in the Privacy Act 1988 (Cth);

“Sensitive Information” has the meaning given in the Privacy Act 1988 (Cth) and includes Health Information;

the words “we”, “our”, “us”, “GuideNest” and “Service” refer to the GuideNest website and mobile application and GuideNest PTY LTD (ACN 691 264 623) and all of its related entities.

This Privacy Policy applies to and should be read in conjunction with the GuideNest End User Terms (collectively, the “Agreement”).

We are committed to protecting your privacy and complying with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

We may, at our sole discretion, amend, add or remove any part of this Privacy Policy. We will notify you of material changes by posting the updated policy on our Service or by other appropriate means.

Collection of Personal Information

We recognise the importance of protecting the privacy of Personal Information and Sensitive Information. We employ strict policies and security measures to protect the information you provide us.

When you register with us, use GuideNest, or provide us with your Personal Information, you give us consent to process and use such submitted personal data in accordance with this Privacy Policy.

This Privacy Policy applies to all Personal Information collected, maintained or used by us.

Information That We Collect

We collect information to provide our Service to you and to improve our products. We collect information in the following ways:

Information you give to us directly. This includes:

Account information: your name, email address, password, and contact information;

Profile information: information about yourself as a Carer, your relationship to any Child, and your preferences for using the Service;

Information about Children: information you provide about Children in your care, which may include their name, age, developmental conditions, behaviours, routines, progress, and other information relevant to their care and support;

Health Information: information about the health, developmental conditions, disabilities, therapies, medications, or medical history of you or any Child, which you choose to provide through the Service;

User-generated content: notes, journal entries, observations, questions, posts, and other content you create or submit through the Service;

Communications: messages you send to us or through community features of the Service.

Information we collect through your use of our services. This includes:

Device and usage information: information collected by our server, from or about the computers, phones, or other devices where you access our services, including the internet protocol (IP) address, operating system, browser and platform, the pages you visit, your language settings, time zone, and device identifiers;

Cookies and similar technologies: cookies and other similar identifiers which we send to your device for session identification, authentication, and analytics purposes;

Analytics data: information about how you use the Service, including features you access, time spent on the Service, and interactions with content.

Information from third parties. We may receive information from:

Authentication providers: if you choose to authenticate with GuideNest using a social media account or other third-party authentication, we may receive your email address, name, and profile picture;

Other users: if another user of the Service provides information about you.

Sensitive Information

The Service is designed to support Carers of children who are neurodiverse or have neurodevelopmental conditions. As such, we may collect Sensitive Information, including Health Information, about you and about Children.

We will only collect Sensitive Information:

with your consent;

where the collection is required or authorised by law; or

where collection is necessary to prevent or lessen a serious threat to life, health or safety.

By providing Health Information or other Sensitive Information through the Service, you consent to our collection and use of that information in accordance with this Privacy Policy.

If you provide Sensitive Information about a Child, you warrant that you are a parent, guardian, or person with lawful authority to provide that information and to consent to its collection and use on behalf of the Child.

Information About Children

The Service is intended for use by adult Carers.

If you are a Carer, you may provide information about Children in your care through the Service. When you do so, you:

warrant that you have lawful authority to provide that information;

consent to our collection and use of that information in accordance with this Privacy Policy; and

acknowledge that you are responsible for the accuracy of that information.

We treat all information about Children with particular care and implement appropriate safeguards to protect this information.

How We Use Your Information

We may use the information we collect to:

provide, maintain, and improve the Service, including personalising your experience;

create and manage your account;

provide support tools and features to assist you in caring for Children;

enable community features and connections with other Carers;

respond to your enquiries and provide customer support;

send you service-related communications, including updates, security alerts, and administrative messages;

analyse usage of the Service to improve functionality and user experience;

develop new features and services;

protect the safety and security of users, including Children;

comply with legal obligations and enforce our terms and policies.

We will not use your Personal Information for direct marketing purposes without your consent.

Artificial Intelligence and Data Processing

The Service may use artificial intelligence, machine learning, or similar technologies (“AI Features”) to:

analyse information you provide and generate suggestions, insights, or recommendations;

personalise your experience with the Service;

identify patterns or trends in information you provide; and

improve the Service and develop new features.

When you use AI Features, the information you provide may be processed by AI systems to generate outputs. You acknowledge that:

AI-generated outputs are provided for informational purposes only and should not be relied upon as professional advice;

we may use aggregated and de-identified data to train and improve our AI systems;

you can contact us if you have questions about how your data is used in connection with AI Features.

Disclosure of Your Information

We may disclose your Personal Information to:

Service providers: third parties who provide services to us, such as hosting, data storage, analytics, payment processing, and customer support, who are bound by confidentiality obligations;

If you use any community features of the Service, information you share may be visible to other users. Please exercise caution when sharing information in community spaces.

We protect your Personal Information by:
